hidnscroll DMCA Takedown Policy

Hidn International, Inc. ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects all users of the hidnscroll platform to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), 17 U.S.C. Section 512.

1. Reporting Copyright Infringement

If you are a copyright owner or an authorized agent of a copyright owner, and you believe that content hosted on hidnscroll infringes your copyright, you may submit a DMCA takedown notice to our designated agent.

Your notice must include all of the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the platform (e.g., direct URL links to the content).
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

2. Designated Agent

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

3. Processing of Takedown Notices

Upon receipt of a valid DMCA takedown notice, we will take the following actions:

  1. Acknowledge receipt of the notice within two (2) business days.
  2. Review the notice to confirm it meets the requirements of the DMCA.
  3. Remove or disable access to the allegedly infringing material promptly after confirming the validity of the notice.
  4. Notify the content creator whose material was removed or disabled, providing a copy of the takedown notice and information about the counter-notification process.

4. Counter-Notification

If you are a creator on hidnscroll and believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent.

Your counter-notification must include all of the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, the District of Delaware), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.

5. Restoration of Content

Upon receipt of a valid counter-notification, we will:

  1. Forward a copy of the counter-notification to the original complainant.
  2. Inform the original complainant that the removed material will be restored in ten (10) business days, unless we receive notice that the complainant has filed a court action seeking to restrain the creator from engaging in the infringing activity.
  3. Restore access to the removed material within ten (10) to fourteen (14) business days after receiving the counter-notification, unless we receive such court order notice.

6. Repeat Infringer Policy

In accordance with the DMCA and our Terms of Service, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

  • First offense: Content removal and written warning.
  • Second offense: Content removal, temporary account suspension (minimum 7 days), and written warning.
  • Third offense: Permanent account termination.

We reserve the right to terminate any account at any time if, in our sole discretion, the user is determined to be a repeat infringer regardless of the number of prior offenses.

7. Good Faith Requirement

Please note that the DMCA provides that any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from any party that submits a notification of claimed infringement or counter-notification in bad faith.
